Court Grants Emergency Order Against Gailen David

On September 8 and September 10, 2020, a two-part evidentiary hearing was held in the Circuit Court of the Eleventh Judicial Circuit in and for Miami-Dade County, Florida, on an Emergency Motion for a Temporary Injunction filed by En Pointe Productions and its principle members against former co-owner and travel show co-host, Gailen David, relating to events which have transpired over the last several months.

After considering En Pointe’s Motion, Mr. David’s Response, the testimony of witnesses, evidence that was entered into the record by the Parties, and the arguments of the Parties’ respective attorneys, the Court granted En Pointe’s Motion and entered a Temporary Injunction against Mr. David.

Significantly, the Court found that En Pointe Productions and its principle members would suffer immediate and irreparable injury, loss and/or damage if an injunction were not entered against Mr. David, and further found that En Pointe and its principle members have a substantial likelihood of success on the merits in the underlying litigation between the Parties.

As a result of the Court’s Order, Mr. David has been ordered to, among other things, immediately cease and desist making, posting, publishing, or otherwise disseminating any defamatory or disparaging statements or communications relating to En Pointe Productions and its principle members until further Order of the Court. Further, he may not contact, in anyway, any of clients or business partners of En Pointe.

In mid-November the principle members filed a motion citing evidence that Mr. David violated the court’s order. Additionally filed, a set of statements En Pointe and it’s remaining members have asked Mr. David to admit to, along with interrogatories that will highlight the truth and facts in the case.
